San Diego Personal Injury Lawyer – Mova Law Group has secured a $4 million settlement on behalf of a 61-year-old woman who sustained catastrophic injuries after being struck by a van while lawfully crossing the street in a designated crosswalk in Chula Vista.
According to the case, the van’s driver failed to stop at a stop sign and violently struck the pedestrian, propelling her into the air before she landed on the asphalt. The driver then fled the scene, leaving her unconscious, without a pulse, and in critical condition.
Emergency responders performed cardiopulmonary resuscitation and successfully restored her pulse before transporting her to UC San Diego Health for advanced trauma care.
The collision caused a severe traumatic brain injury, fractures to both femurs, deep lacerations, nerve damage, and other life-altering injuries. She underwent three emergency surgeries and later spent more than two months in a skilled nursing facility.
Despite extensive treatment and rehabilitation, she continues to experience chronic pain, cognitive impairment, post-traumatic stress, and permanent mobility limitations. She now requires a cane or walker for assistance.
A major dispute in the case concerned whether the driver was acting within the course and scope of employment at the time of the collision. The company’s insurer initially maintained that the driver was not working for the company when the incident occurred and attempted to distance the business from responsibility for the crash.
Through litigation and a detailed investigation into the driver’s activities at the time of the collision, Attorney Chris Mova and his legal team developed evidence establishing that the driver was, in fact, working for the company when he struck the client.
Once the employment relationship and corresponding corporate responsibility were established, the insurer agreed to tender the full $4 million available under the applicable insurance policy.
